Trump's former lawyer steps down following judicial disqualifies her.
Alina Habba has left her position as the chief federal prosecutor in the state. This comes after a judicial decision that questioned her legal standing to hold the office.
Acceptance of Resignation
The head of the Justice Department, the Attorney General, accepted the prosecutor's departure on the start of the week. In a statement that the court's "flawed" ruling made it "untenable" for her to lead the department effectively.
"Do not interpret adherence to the ruling as defeat," she declared. "The effort will now reach across America."
Judicial Challenge
Her resignation follows closely on a US appeals court found that she had been unlawfully serving as US attorney. This decision is likely to affect scores of prosecutions in the Garden State.
The judicial panel ruled that a acting appointment that did not receive Senate approval violated the statute on vacant positions.
Next Steps and Responses
Bondi said that she will stay on at the Department of Justice as a high-level advisor. Habba plans to pursue additional appeals of the court's action, aiming for a reversal.
On a social media platform, the Attorney General wrote that the judiciary "should not be able to second-guess the President's choice of attorneys tasked with carrying out the primary duty of the administration of prosecuting crime."

She highlighted her tenure and noted that while she was in charge, the city of Newark saw a one-fifth decrease in criminal activity. Additionally that the southern city of Camden had its first summer in half a century free from homicides.
Connection to Donald Trump
Habba, 41, was initially recruited to Trump's personal legal team in recent years. She later represented Trump in his New York criminal case in 2024, leading to his conviction on multiple felony counts of falsifying business records.
Earlier, assuming the role of US Attorney, the former president had announced he was selecting her as his senior adviser if re-elected, describing the lawyer as deeply loyal and a relentless legal advocate.
