Previous Australian Politician Jailed for Above 60 Months for Sex Crimes

One-time Australian politician sentenced of sexually abusing two individuals encountered via his position has been sentenced to five years and nine months in detention.

Legal Proceedings

Gareth Ward, 44, has been in custody since last summer after the court determined his guilt of sexually assaulting an individual and indecently assaulting another, in separate incidents in over two years.

Ward acted for the coastal town of Kiama in the NSW legislature from over a decade ago. He resigned as a political party minister when the claims emerged in 2021 but refused to quit parliament and won again in 2023.

Judgment Information

The presiding officer the court official considered the defendant's condition of sight disability in the judgment and found "no other penalty except for detention would be suitable".

The defendant, who appeared via digital means at Parramatta District Court, will undergo at minimum nearly four years in prison before he can request conditional freedom.

Justice Shead said the legal system needs to "issue a clear statement to potential criminals that criminal acts of this nature will be faced with serious punishments".

Additionally stated the defendant had "avoided punishment for multiple years and lived freely free from a rehabilitation program or penalty for the offenses during that time".

After his conviction, Ward attempted a rejected legal bid to stay in parliament and resigned moments before the legislature could remove him.

Defense attorneys has previously said he plans to challenge the ruling.

Case Facts

Ward's lengthy proceedings in the state court was told that he invited a drunk teenager to his home in the first incident and attacked him on multiple occasions, despite resistance attempts to oppose.

Two years later, he sexually assaulted a mid-twenties political staffer at his residence after a gathering at the legislature.

Ward had claimed the second incident never occurred, and that the additional accuser was confused about their meeting from the first incident.

However, prosecutors contended that significant resemblances in the statements of the two men, who had no connection to the other, showed they were being honest.

Court members deliberated for three days before delivering the convictions.

The political exit prompted a by-election in Kiama in last fall, which was won by the Labor candidate.
